CityNews Nigeria recalls that the Federal High Court sitting in Umuahia, the Abia State capital had directed the Federal Government to return Kanu to Kenya and pay him N500 million.
Reacting to the ruling on Thursday, Malami said the rendition of the IPOB leader could not be used as the only basis to release him from the facility of the Department of State Services (DSS).
The minister, in an interview with Vanguard, said the court order cannot be used to free Kanu of other offences levelled against him by the Federal Government.
Malami noted that the government is holding onto Kanu on account of four major issues, which were preceded by the rendition matter for which the court cleared him.
In a statement on Saturday by its spokesman, Emma Powerful, IPOB described the comments made by Malami concerning the court judgment on Kanu as disgraceful and irresponsible.
IPOB said all the charges and cases Malami cited during his interview were embedded in the cases quashed by the appeal court, asking the minister to broaden his knowledge of the law.
The group also accused Malami of transferring the Appeal Court justices who had earlier ruled on the matter and replaced them with new ones in order to manipulate the judicial process, an allegation the appellate court had denied.
The statement read, “Malami transferred the Appeal Court justices who had displayed sincerity on the matter on October 13, 2022, in order to work on the minds of the newly appointed judges and has used them to order a stay of execution of justice which they carried out on Friday, October 28, 2022.
“What a shame to these judges who were just selected a week ago to carry out this injustice to allow the stay of execution of orders by the same court only two weeks ago. They have displayed their ignorance of the law and their willingness to act unjustly due to their lack of independence for allowing themselves to be used.
“Malami should go back and read his law books again because all the charges and cases he cited during his interview with the media were embedded in the cases quashed by the Appeal Court. He is just exhibiting ignorance and myopic understanding of the law and the Constitution of the same country he claims to be representing. He should redeem some of his credibility by simply obeying the court orders.
“The world is watching his ignorance of the law. We are laughing at him because his reputation and that of Nigeria is going down everyday as they keep disobeying their own courts.
“Let Malami and his collaborators know that their hatred against Kanu and Ndigbo will destroy them and Nigeria soon. As Attorney General and Minister of Justice, he ought to uphold the laws, but has decided to be lawless and defiant to court orders, exposing the Federal Government as a Banana Republic that it is.
“Malami has no other option but to release Kanu and stop disgracing himself and the Federal Government. Nigeria has a lot of brilliant lawyers who are supposed to be appointed as attorneys.
“Those who understand the law should advise Malami and his co-conspirators in the Ministry of Justice to know that he is representing the Federal Government not a Sharia Court system or his All Progressives Congress party.”
