After a long legal battle, an Ilorin Magistrate Court, presided over by Magistrate Muhammed Adams, on Tuesday delivered judgement, dismissing case against ace movie producer and a traditional ruler, the Oloba of Isale-Oba, Sanmora, lrepodun Local Government Area of the state, Alhaji Maroof Adebayo Afolayan.
It would be recalled that the defendant was dragged to court by the police in March, 2022, on the allegation of false personation and inciting public disturbance but the court in its judgement on Tuesday discharged Oloba of all the offences levelled against him.
In the over 40 pages judgement, the court held that the prosecution failed woefully to establish the case of the alleged offences against the defendant thereby striking it out in its entirety.
Magistrate Adams, in the judgement revealed that the testimony of the six prosecution witnesses claiming that Oloba was purportedly dethroned was invalid on the basis that the court lacks jurisdiction to try issue on chieftaincy matters.
The court, through the video evidence presented by two defence witnesses, established that the Eleju of Eju Land, Oba Mathew ldowu Ajiboye and his accomplice, molested Oloba and his family beating him almost naked
Magistrate Adams delivered a significant verdict, stating that the prosecution failed to provide sufficient evidence to support their case against Oloba, emphasing that the prosecution didn’t establish any essential elements of the alleged offences, effectively weakening their claims.
Meanwhile, the Oloba had earlier dragged the Eleju and his accomplice before Magistrate Badmus for attempted murder, theft and assault.
Also, the Eleju, Oba Mathew ldowu Ajiboye is facing trial at the State High Court, before Justice Hammed Gegele for allegedly selling lands belonging to the Oloba Royal family and the matter is coming up next month for further mention.
